TERMS AND CONDITIONS


1.             Introduction. Please read this page carefully. It contains the terms and conditions governing the use of HR-1 Corp. forum (as defined below) as provided by HR-1 Corp on behalf of itself and its third party clients. If you do not accept these Terms and Conditions or you do not meet or comply with the provisions herein, you may not use the HR-1 Corp forum or services. These Terms and Conditions are effective August 8, 2019.

 2.             Binding Agreement. These Terms and Conditions (as they may be amended from time to time by HR-1 Corp.) are a binding agreement (the "Agreement") between the user and HR-1 Corp. Access to or use of the HR-1 Corp. forum and or its services indicates your acceptance of these Terms and Conditions.

 3.             User Submissions. HR-1 Corp. provides a forum for users to obtain employment and career information. By using HR-1 Corp. forum including the submission or entering of your information to HR-1 Corp. ("Submitted Material"), you agree and authorize HR-1 Corp. a perpetual, non-exclusive, irrevocable, royalty free, worldwide license and right, but not an obligation, to use, copy, modify, display, distribute, download, store, reproduce, transmit, publish, transfer, adapt, create derivative works in any manner, in entirety or a portion of, of your Submitted Material, and by any means, forever and worldwide. You acknowledge and accept that HR-1 Corp. forum is only a forum for users to obtain employment and career information. HR-1 Corp. makes no guarantee that Submitted Material will be monitored, screened, or acted upon in any way. HR-1 Corp., therefore, makes no representation regarding the reliability, accuracy, completeness, validity, or truthfulness of any Submitted Materials. HR-1 Corp. reserves the right, in its sole discretion, to delete, remove, refuse to display, or block any Submitted Materials that HR-1 Corp. considers to be unacceptable. In the event HR-1 Corp. receives notification regarding any unacceptable Submitted Materials, HR-1 Corp. may investigate such materials, in its sole discretion. You acknowledge and agree that HR-1 Corp. may retain copies of your Submitted Materials and disclose your Submitted Materials to a third party if HR-1 Corp. believes that it is necessary for any reason, including but not limited to: (i) protect the integrity of the forum; (ii) protect rights of HR-1 Corp.; (iii) comply with any court order; (iv) comply with any legal proceedings; (v) assert HR-1 Corp.'s claim under this Notice; and (vi) satisfy any claims regarding violations of third party's rights.

4.             DISCLAIMER. HR-1 CORP. MAKES NO REPRESENTATIONS OR GUARANTEES REGARDING THE EFFECTIVENESS OF THE SERVICES OR TIMELINESS OF THE SERVICES IN MEETING EMPLOYMENT OBJECTIVES. HR-1 CORP. DOES NOT GUARANTEE THAT SERVICES WILL RESULT IN CANDIDATES BEING IDENTIFIED OR HIRED, POSITIONS BEING FILLED OR EMPLOYEES BEING RETAINED, AND HR-1 CORP. IS NOT RESPONSIBLE OR LIABLE FOR ANY BUSINESS, EMPLOYMENT, HIRING AND/OR SALARY DECISIONS, FOR WHATEVER REASON MADE.

 5.             RESPONSIBILITY AND RISK. USER ASSUMES ALL RESPONSIBILITY AND RISK FOR USE OF THE HR-1 CORP. FORUM AND SERVICES, THE INTERNET GENERALLY, AND THE SUBMITTED MATERIALS OR ACCESS OF HR-1 CORP. FORUM AND SERVICES.

 6.             INDEMNIFICATION. UNDER NO CIRCUMSTANCE SHALL HR-1 CORP. (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY NON-DIRECT DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RESULTING FROM LOST DATA, LOST EMPLOYMENT OPPORTUNITY, OR BUSINESS INTERRUPTION) RESULTING FROM OR ARISING UNDER OR IN CONNECTION WITH SERVICES OR THE USE OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THE HR-1 CORP. FORUM AND SERVICES AND/OR ANY SUBMITTED MATERIALS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT HR-1 CORP.  IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 7.             LIABILITY LIMITATION. IF ANY LIMITATIONS SET FORTH BY THIS AGREEMENT ARE HELD INAPPLICABLE OR UNENFORCEABLE FOR ANY REASON, THEN HR-1 CORP. MAXIMUM LIABILITY FOR ANY NON-DIRECT TYPE OF DAMAGES SHALL BE LIMITED TO U.S. $200.00 IN THE AGGREGATE. IN NO EVENT SHALL HR-1 CORP. (OR ANY OF ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, SUBSIDIARIES, AFFILIATES, AGENTS OR ADVERTISERS), BE LIABLE FOR ANY DIRECT DAMAGES IN EXCESS IN THE AGGREGATE OF U.S. $200.00.

 8.             EQUITABLE RELIEF. DUE TO THE NATURE OF THE AGREEMENT, IN ADDITION TO MONEY DAMAGES, YOU AGREE THAT HR-1 CORP. WILL BE ENTITLED TO EQUITABLE RELIEF UPON A BREACH OF THIS AGREEMENT BY THE USER.

 9.             No Promise of Hire. User understands and agrees that HR-1 Corp. (a) does not warrant that users will receive any employment or job offers through the forum; (b) shall not be responsible for any employment offers, employment screenings, employment decisions, and actual employment presented by third parties; (c) does not guarantee the accuracy, completeness, validity, or timeliness of information listed by any third parties; (d) shall not be responsible for any materials posted by third parties, including, but not limited to, job openings and employment listings; (e) is neither your employer nor your agent in any regard; and (f) the act of providing Submitted Materials through the HR-1 Corp. forum does NOT result in an application of employment and cannot be relied upon to be considered an expression of interest. User shall exercise individual judgment, caution, and common sense in evaluating any prospective employers and any information provided by any third party.
